On the foreign borrowings in the Islamic Law during Its Formation Period

Abstract

The article analyzes the problem of the Roman and Judaic law concept and their legal institutions influence on the Islamic Law. This issue has been under discussion among the scholars since the XIX century. The article presents different approaches on the problem by the Western prominent authors. The article provides an appraisal of the historic role played by the Beirut Law School, as well as gives a brief analysis of the Syro-Roman Law Book as an important historic document. The problem of the foreign borrowings in the Islamic law still remains without special consideration in the scholarly literature in Russia.
