К вопросу об иностранных заимствованиях в период формирования исламского права

Аннотация

Статья посвящена проблеме наличия в исламском праве правовых институтов и концепций, заимствованных из римского и иудейского права. Данная проблема вызывает широкие дискуссии среди ученых с начала XIX в., продолжающиеся до сих пор. Рассматриваются взгляды на проблему ведущих западных авторов. В контексте исследования дается оценка исторической роли Бейрутской школы права и характеристика важнейшего исторического памятника «Сирийско-римский судебник». В русскоязычной литературе проблема иностранных заимствований в исламском праве практически не исследовалась.
